Terms of Use

Please read these Terms before using MagicReader. In particular, note Section 3 — Health, safety & assumption of risk: the touch-free features use real movements of your head, eyes, and hands, and you use them at your own risk.

By downloading, installing, or using the MagicReader mobile app or the MagicReader web reader (together, “MagicReader” or the “App”), you agree to these Terms of Use (“Terms”). If you do not agree, please do not use MagicReader.

1. What MagicReader is

MagicReader is a reading app that lets you read public-domain books and turn pages “touch-free” using camera-based gestures (head, eye, and hand movements) and optional voice commands, as well as ordinary taps and keys.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use MagicReader for your own personal, non-commercial use, subject to these Terms and to the rules of the app store you obtained it from (Apple App Store or Google Play).

3. Health, safety & assumption of risk

MagicReader’s touch-free features rely on physical movements of your head, eyes, and hands. Please use them safely and sensibly:

MagicReader is not a medical, fitness, or therapeutic device and makes no health-related claims.

4. Acceptable use

You agree not to misuse MagicReader — for example, not to reverse engineer, resell, or redistribute it except as permitted by law; not to use it for any unlawful purpose; and not to interfere with its operation or security.

5. Books & third-party content

MagicReader helps you access public-domain texts provided by third parties such as Project Gutenberg and Aozora Bunko. These texts are provided by those sources “as is.” We do not create, own, edit, verify, or endorse their content and are not responsible for its accuracy, completeness, or any views expressed in it. Public-domain status can vary by country; you are responsible for ensuring your use of any text is lawful where you live.

6. Intellectual property

The MagicReader app, its name, design, and software are owned by its developer and protected by law. Public-domain book texts are not owned by MagicReader. These Terms grant you no rights in the MagicReader software other than the limited license in Section 2.

7. Disclaimer of warranties

MagicReader is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that gesture or voice recognition will be accurate, uninterrupted, error-free, or suitable for any particular person or device, or that the App will be available at all times.

8. Limitation of liability

To the maximum extent permitted by law, in no event will MagicReader’s developer be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, bodily harm, loss of data, or loss of profits, arising out of or related to your use of (or inability to use) MagicReader — including any injury or discomfort related to head, eye, hand, or other movements — whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if advised of the possibility of such damages. To the maximum extent permitted by law, the developer’s total liability for all claims relating to MagicReader will not exceed the greater of the amount you paid for the App (if any) or US $50.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. In that case, our liability is limited to the smallest amount permitted by law.

9. Indemnification

You agree to indemnify and hold harmless MagicReader’s developer from any claims, damages, or expenses arising from your misuse of the App or your violation of these Terms.

10. Changes

We may update these Terms from time to time. Continued use after changes take effect means you accept the updated Terms. The “Last updated” date above shows the current version.

11. Termination

You may stop using MagicReader at any time. We may suspend or end this license if you violate these Terms.

12. Governing law

These Terms are governed by the laws of [your state / country], without regard to its conflict-of-laws rules. [Optional: the courts located in your city / state have exclusive jurisdiction.]

13. App-store terms

Your use of the App is also subject to the terms of the store you downloaded it from. Apple and Google are not responsible for MagicReader or for any claims relating to it, and are not parties to these Terms.
